State of Miss Sir It becomes my duty to report the unpleasant fact of the escape from custody at this place of J E Simmons arrested in Neshoba County Miss on the 29" inst and held at this place until the evening of the 30" inst per instructions contained in endorsement dated Hd Qrs Sub Dist of Miss Vicksburg Miss Nov 25" 1867. report of which was made from this Office on the 30" inst. In connection I beg leave to say. concerning the arrest of Simmons that it could not have been done in the manner it was done (Viz without greater numbers) if he had chosen to resist, from the fact that he lives in a locality where he can command the personal assistance of a number of his comrades at short notice. Simmons appeared very submissive indeed, and expressed his entire willingness to submit himself to trial on the charges preferred against him, and represented that he had already communicated to the Commanding General such disposition. The fact of his having escaped it is not at all probable that another arrest could be effected particularly in the locality in which he lives without greater force than was required in this instance. From what information that can be obtained at present it is probable that he may have returned home but equally improbable that he will remain there any considerable length of time; He stated in conversation that he is a Photographer and is engaged in that business traveling about the country. Simmons is a man about 30 years of age, sandy complexion full face sandy curly hair worn short light eyes about 5 feet 6 inches, weighs about one hundred and fifty pounds wears a light Mustache and Goatee rather prepossessing in his appearance and conversation, any further information that can be obtained by this Office will be duly reported.
