I have the honor to acknowledge receipt of your communication of the 6" inst in relation to personal abuse and cruelty at the hands of Claibourn Keeton (freedman) upon his wife and children on the 5" inst. In reply I beg leave to suggest that in all cases of this kind the Statutes of the State of Miss provides a penalty, and upon a complaint being made under oath before a "Justice of the Peace" who has jurisdiction over the section of Country where the offense was committed it becomes the duty of such Magistrate to proceed against the person or persons so offending according to law. Any unreasonable hesitation on the part of such Magistrate - before whom complaint is made - to take prompt action according to law, would be considered sufficient pretext for action concerning the removal from office of such delinquents. The duties of this Office will not at this time justify the absence of the undersigned for the purpose mentioned in your communication and it not deemed necessary from the fact that the matter can be proceeded with quite as well without the presence of an officer of the U.S. Government.
