with aiding and abetting in the killing of a white man in the lower end of this Country, some two months since, it was in evidence that the only part taken by the accused was to hand his companion, another colored man, an unloaded pistol, with a view of intimidating the white man from further pursuit:- that the latter continued the pursuit, hurling an axe at the party to whom the pistol was handed, who in turn dealt the white man a blow with the same one, causing his death, and then escaped. The accused was found guilty and sentenced to ten (10) years in the Penetentiary.  His counsel, however, appealed for a new trial which he informed me was to have been granted; but in the meantime the prisoner, with three others, made his escape from the County Jail, and none of them have since been heard from.
