Robert White Cold

Continuation of Endorsements on Communication of L.M. Shoemaker relative to trial of Robert White (Cold &c &c (S.22)

Danville Va Feby 3d/66
Respty returned to Capt R.S Lacy aqm & supt 7" Dist Va with the information that Rob't White was tried Cold before the freedmens Court of this county and found that he had been tried once by the court of Hastings of the town of Danville and discharged for want of jurisdiction (more on account of there being no evidence to show that he committed the felony).

The freedmens Court decides that the court of Hastings had jurisdiction over the case and therefore his life cannot be put in jeopardy twice for the same offence and do therefore discharge him.

The freedmens Court in trying persons charged with crimes. the penalty of which exceeds three months imprisonment and $100. fine. merely consider it an Examining Court in order to find out whether the persons are guilty or not of the crimes charged with. if there is the least evidence to show that the party is in any way guilty the case is turned over for trial before a higher Military tribunal.
I informed L M Shoemaker that if the prisoner White was found guilty of the felony he would be turned over to the Military Authorities for trial before a commission
