This seems to me to be a case in which clearly the property ought to be returned to the owner. It is not confiscable, and as I understand the law and policy of the government it is not claimed that property is liable to siezure which is not confiscable where the owner is present. It is not claimed that property is confiscable where the party who is supposed to have committed the office is dead as in This case. I hope that property may be returned to the petitioner.
