Respty returned. The within mentioned tract of was leased last January by Capt Wilder to one Sam Paine (col'd) for $200. payable quarterly, this for the year 1866 only. It was at that time arranged that said Paine was not to receive the lease in writing until he should pay the first installment of rent due April 1st. 

This was done as an incentive to Paine to be prompt in his payment and to save the Bureau from a worthless tenant, and this was the custom of Capt Wilder in renting lands to freedmen.

At the restoration of this property there was therefore no lease of it in writing.

I informed Mr Jones that I considered the lease one done in good faith by competent parties and recognized it. 

Said Paine duly paid the first installment to said Jones not "for the rent of this year" but for 1st quarter 66.

The parties now in possession are not the parties in possession last year — the latter failed to pay anything whatever. Therefore Capt Wilder leased said land to better men withholding a written lease till they should prove their ability to pay.

Paine is a trustworthy man, has caused

the land to be put under cultivation, supposing he had a valid lease, he had the best he could get, and I trust the interests of the freedmen will not suffer by the restoration of this property
