took the horses from the Confederate Army- and received the authority he represents in his letter to hold them. When the order was issued to report all Government property to the Provost Marshall, Mr Spear failed to comply therewith. 
Mr Dodd reported the horses held by Mr Spear and Captain Keough 188" Penn Vols then Pro Mar gave an order to Mr Dodd. for the two horses and a certificate (which he now holds) to hold one of the horses till called for by the United States.  The other horse Capt Keough sold to a Mr Loving of this town. Mr Dodd remained in possession of the horse till Feb'y last when Mr Spear took forcible possession - by virtue of an article in one of the Richmond papers purporting to be an extract from an order from the Qr Mr Genl setting forth that hereafter no horses branded "C.S." should be molested by U.S. Officers.
Mr Dodd applied to me for his horse. and I directed him to make direct application to H'd Qrs setting forth all the facts.
Mr Spear states that Capt Keough turned over to him a horse branded U.S. in place of the one sold to Mr Loving & which horse he now has.
