Respty returned with report. that on the receipt of the within communication I proceeded to Lancaster Co. and after a thorough investigation I formed from the confession of McClenahan and the statements of those living in the vicinity. that there could be no doubt of the fact of McClenahan having killed the man.
He claims that the man attacked him and that the killing was unintentional on his part, and in self defence.
In compliance with the provisions of Circular No. 10. Bu of R F & A L dated Richmond Va March 12th 1866, I immediately turned him over to the Civil Authorities of the county for trial. I have been notified by the attorney for the Commonwealth, that his trial will take place on the second Monday in May 1866 at which I shall be present. and act in accordance with the provisions of the above named Circular. In relation to the alleged insecurity of the lives of the loyal men and Freedmen. I have to state that in my opinion. their lives are as secure as any other class of people.
A feeling of hostility no doubt exists to some extent, but the only act of hostility that has come to my knowledge is the one referred to within. I have had no cases of assault since I have been stationed here, and have had no occasion to inflict a fine upon either Freedmen or whites. The within case occurred before I came here and was never reported to me.

Mr Roberts stands in the same relation to to the Military Authorities as any other government employee and is therefore under martial law
You have nothing to do with his claim against Capt Nat Low Jr.

No agent will be paid more than $3.00 per day for each full day he was actually on duty

The amount received and paid out will be accounted for as heretofore directed.
