The Defendent John Pollard has made a personal application that from reasons connected with his duties as administrator & the necessity for future litigation in the Civil Courts, the within claim under the will should be tried by the Circuit Court of Hanover County -- and states that he is willing to pay at once that portion of the judgement of the court which awarded to the Plaintiff Pleasant Smith his wife and children the sum of $293.85 of which $225.15 carries interest from March 1st 1866 -- the same being for hire and not claimed under the will. If the said defendent makes the said payment within a reasonable time the residue of the case being the claim under the will, will be withdrawn from the jurisdiction of the Freedmens Court for Hanover County, and the plaintiff's will be instructed to bring their claim

before the Civil Courts in which case the Asst Supt will report the action of the said Court in the matter.
