The penalty for such an offence is Stripes or imprisonment from one to twelve Months at the option of the jury. In the Case Cited, the Jury sentenced the Man to two Months imprisonment in the County Jail, — The Commonwealths Attorney in Open Court, Stated he would not press the infliction of Stripes in this Case, as he desired to reserve that punishment for the first White man Convicted of a like offence
