The negro being ignorant, and passionate, can very easily be made to commit himself, and I have no hesitation in saying should no witness be present, either white or Black, the white man would have the precedence, as his testimony would be taken and the public community hold him up in it above the black man; - for where will it be discovered that a colored man's testimony, where it is in between White & Blacks is allowed gentlemanly, or just, in the eyes of Southern men. - as a general rule = 

Out of many cases coming before me there are those it is impossible for me to find proof to establish the guilt of either party, therefore I have advised the colored parties to desist from further action and this is the case in nine tenths of disturbances raised. Still it is apparent that some one is to blame: but if none but the two parties were present it would be useless for the case to go on as there is a certainty the colored person would loose the case, and be brought to expense.
