last term of the County Court, and altho. the testimony upon which he was acquitted — if he was acquitted upon testimony at all — was mostly colored and was all for the prosecution, yet from remarks that were made by the Counsel for the defence whilst making his plea, and from many outside reports, and from developments which have been made since the trial, there is, as I think, good and sufficient reasons to beleive that undue and impropper influences were brought to bear upon the Court.

In the plea of the Counsel for the defence the following language was used with reference to the deceased — or murdered man —

"This federal Nigger fresh from the Northern Army, taught to murder by the Yankee Soldiers &c." and again in alluding to the fight which resulted in the death of Howard he says to the Court "This was a political quarrel, the accused is a Conservative, and Howard was a Radical Nigger"
