a child 5 yrs old, with a stick; and also that Latham caught the child by the hair of the head, and raised him from the floor. Mr Latham admitted the assault but the case was dismissed with $1.60 costs to the colored woman  Subsequently however the costs were charged to the Commonwealth. In contrast with the above, I would invite your attention to a case tried before the County Court at Winchester on Monday Nov. 1st in which Emanuel White (colored boy) was charged by _ Jackson (white boy) with an assault at Jordans Springs in this County. The evidence for the prosecution in this case demonstrated that White was employed by Mr Jordan, and on the occasion of a ball at the hotel of Jordan, White was instructed by his employer to keep persons from looking in at the windows. Jackson in opposition to these instructions persisted in looking in, and when ordered away, refused to go, when he was struck by White and knocked down. For the defence, two colored servants testified that White was in the kitchen with them at work on the evening in question, and that hearing a disturbance the three ran out together in their shirt sleeves: that White got in advance & that they did not see him commit an assault on Jackson. The case was submitted to a Jury, who brought in a verdict for Plaintiff against the Defendant of seventy five ($75.00) dollars.
