I have the honor to report in compliance with Circular No. 10. Hd. Qrs. Asst. Com'r. Dist. Va. that there has been but one criminal trial of freedmen in this Division during the present month as follows: 

Commonwealth vs. Paul Carter, charged with an attempt to commit a rape upon a white woman, tried at the last term of the county court and although the Commonwealth's attorney remarked to me after the jury had retired that he thought they must acquit him as there was no evidence to sustain the charge, yet strange to say they brought in a verdict of (3) years in the penitentiary, but on motion of counsel he was granted a new trial.
