Isaac Custis (col) v.s. Miles Cary (col)

The plea of Custis in this case is that Cary borrowed a cart of him in 1862 and has never returned it.  Nor has he (Custis) ever received pay for said cart.

Witnesses for Plaintiff.

Isaac Custis, sworn.
Live in Williamsburg.  Lived there 13 years know Miles Cary.  Known him 7 or 8 years.  He borrowed a cart of me in Williamsburg in 1862 to carry his wife to Yorktown.  He was going to return it when he came up.  He never returned it.  It was worth $10.00 or $15.00   Worth $10.00   It had good wheels. - not so good a body   I bought the cart.  Dont know the mans name from whom I got it; paid 15 dollars for it; used it 2 years 
Have asked him to return it.  He said he couldn't get up here with the cart on account of military [[strikethrough]] obstruction [[/strikethrough]] orders   He sent answer he couldnt come with the cart.  Told me to come after it.  Never returned any part of the cart.  Dont know where the cart is.

Miles Cary sworn.
Live at Newtown below Yorktown.  I borrowed a cart of Custis.  Dont know the day or year.  Borrowed it before "Wise's raid" to go down to see my wife
