deposes as follows. Was employed by Robert Ruffin as Miller closed the Mill on the night of July 3 1866 left four bags there belonging to J Baker took the key to Robert Ruffin did not go the mill on the 4th of July 1866 on Friday morning the 5th July met Richard Wilkinson who told him the Mill had been robbed saw corn sprinkled over the road. Wilkinson said who ever had taken the corn must have gone the way they were now passing. Went the Mill and examined the place and found that a plank in the floor had been taken up and supposed the corn had been carried out that way there was loose corn under the floor where the plank was taken up. do not know who tore up the plank do not know who took the corn. was not in the Mill from the night of the 3rd to the morning of the 5th.

Clayborne Holmes. (Col'd) being duly sworn deposes as follows. on the afternoon or evening of the 3rd July after getting through his work. went to Ruffin and asked him if Tibbs might grind one half bushel of corn for him. Ruffin said he might. Tibbs ground the corn for him, stayed in the mill until Tibbs was through. left with him. saw four bags of corn which he heard belonged to Baker. saw Tibbs lock the Mill. heard the Mill had been robbed on Thursday morning. do not know whether the Mill ground on the 4th July. do not know if the mill was open on that day
