Action for Ejectment

Barnett Jones states that the defendant is now occupying a house that he (Jones) has leased from the owner. for this year and will not vacate.

William Goodwin. states that the owner Mr. Warren agreed to rent him the house and lot and Oyster privilege, for one hundred dollars, for this year. the money to be paid in advance. there was no writings and I did not pay the money.

Barnett Jones being duly sworn states, I was in company with Mr Warren and W'm Goodwin, during the conversation about renting the place, heard Mr Warren ask one hundred dollars. as rent for the place the money to be paid in advance.  Mr Warren said I have no claim below low water mark.  They agreed to meet at Mr Warrens house on the farm the next morning to make the final arrangements.  we waited around all the morning and sent after Goodwin but he would not come.  I then rented the place from Mr Warren myself, paying the one hundred in advance and received receipt therefor, and ask that the Court put me in possession.

The Court unanimously decided that W'm Goodwin vacate the premises in ten days.
