settlement could be made until the crop was gathered and fairly divided. After a full hearing of the case the court decided that Sam Taggert had forfeited his contract and his share of the crop, and left it optional with Fuller to retain him on his place or dismiss him from which decision Fuller took an appeal to the county court. The Justice's court then committed Sam Taggert to jail in default of one hundred dollars bail for his appearance at the county courts.
The fact was stated to the court that Sam Taggert had negotiated his name and swore that he was over the age of twenty one years.  His grandfather testified that he was under that age.  The court declined to entertain that charge as it did not come within its jurisdiction.
