situated in the town of Hampton contains about three and one half acres, one third of which is used as a burial ground by freedpeople and containing about three hundred graves. situated on rear of lot. some distance from road and therefore on the least valuable portion of the land
The petitioner, at personal interview stated that he with the original owners of "Elmington Cemetery" left this county on the breaking out of the late rebellion, and entered the Confederate Army in which they served during the war. Consequently at the time of alleged destruction of cemetery wall, the land herein mentioned had been wholly abandoned by its owners: and being unenclosed and unclaimed was used by freed people as a burial ground.
No attempt has been made by the petitioner (who resides near said lot) to enclose or protect the unoccupied portion (two thirds) nor has any objection or protest heretofore been offered against its occupation as a burial ground.
