Respectfully returned to Capt. W.P. Austin Supt. 8th Dist where attention is invited to accompanying statement of J.F. McElhenny atty for Mack and Nick Hendricks col'd in Jail charged with stealing as set forth in letter, also to statement of Commonwealth Attorney Mr. Astin on the two horse cases and on the boys Mack and Nick cases. In conversation with Mr. Simmons the colored preacher referred to he says he would not feel safe in saying the opposition of the colored man was bought about by the whites. The only imposition perpetrated on Freedmen that I could hear of was the taking of a coat from one of the prisoners which was not restored for two months, and the Feloniously taking of sixty five dollars off an other col'd man by a white man named Smith. This last case I brought to the notice of the Commonwealth attorney who took prompt action to bring the guilty parties to justice. The colored boys in Jail for stealing were in the Union Army they were confined on the 28th of Nov 1866 their character until then was good. They are under 21 years and one is very sick. brought about, the Dr. says by his confinement.

Respectfully returned with the information that the records of this office show that on the 15th of Dec 1865 Lt. Bitner 2nd. Pa Arty then Asst Supt of Cumberland Co bound out as an apprentice to O J. Reynolds a colored minor orphan boy named Stephen I enclose herewith a copy of the Indenture which in my Judgement is informal and not in accordance with the laws regulating such cases - In this case it also does not appear that Stephen's consent in writing was obtained which was necessary he being at that time age 14. I would respectfully urge that I be authorized to annul the Indenture alluded to.
