Respectfully returned to Maj. James Johnson V R.C. S.A.C with the following report. the character Messrs. Bagby and Gouldin. and their qualifications. are such as eminently fit them for the office. Both will accept the position. J. M Gouldin was a militia officer before the war and some doubts are on his mind as to whether or not he is disqualified, tho that he expresses his opinion that it does not disqualify him. I did not feel qualified to venture on opinion on the matter. Mr. Bagby never held any office before. Both are young men. Gouldin held the rank of Col. in the rebel. Army. Bagby held no commissions. Both express themselves loyal to the Government.

David Futly Esq. and find that Areharts suit was thrown out of Court upon a technicality of practice.  demurred as to prompt action which should have been for a breach of covenant and not simple dept. Suit has been renewed in form ordered by Judge Shiffey, and arehart by advice of Counsel
