Know all men by these presents that wee Albert C. Horton and Smith Hogun are held and firmly bound unto William Tharpe in the penal sum of twelve hundred & thirty Eight dollars sixty two & a half cents for the true payment where of wee bind ourselves and each of our heirs firmly by these presents sealed with our seals and dated this 24th day of April 1829
The condition of the above obligation is such that where as an Execution in favour of John Hidgens for the use of William Tharpe Issued out of the circuit court of Lawrence County Alabama has been Levied by the sheriff of said county on the following described property
To wit Bob Jacob Jonas Abram Nelson West Cato Hetta & Julia two coats one horse and one mule and one Cotton Gin
as the property of William D Hart and whereas the said property has been claimed by Albert C. Horton as his property and affidavit of the [[strikethrough]] said Horton [[/strikethrough]] Title of said Horton having been made as required by law and whereas the said Horton wishes a [[trial?]] of the right of said property now if the said property shall bee found liable to the said Execution and the said Horton shall deliver the said property to the sheriff of said county at the term of such finding at the courthouse in Moulton at the time of such finding and shall pay all costs and damages that may be recovered by in consequence of said claims being made for delay then this obligation shall bee void else to remain in full force and vestur
