This Indenture of three Parts

made the Twenty Eighth day of August in the thirty eighth year of the Reign of our Sovereign Lord George the third by the Grace of God of Great Britain France and Ireland King Defender of the Faith and soforth and in the year of our Lord One thousand seven hundred and ninety eight Between Samuel Smith and Rene Payne of the City of London Bankers of the first part The said Samuel Smith and Rene Payne and their Copartners George Smith and John Smith of the said City of London Bankers of the second part and The Right Honorable Robert Lord Carrington of the third part  Whereas by articles of agreement bearing date on or about the Twentieth day of July last past and made between the said Robert Lord Carrington of the first part the said Samuel Smith and Rene Payne of the second part and the said Samuel Smith Rene Payne and George Smith and John Smith of the third part Reciting that the said Robert Lord Carrington, Samuel Smith and Rene Payne were seized and possessed of or well intitled unto a plantation or penn formerly a Sugarwork called or known by the name of the farm and of two other Plantations or penns called or known by the names of Cow park and Half way Tree penns all situate and being in the parish of Saint Catherine in the County of Middlesex in the Island of Jamaica and of all and singular the Lands belonging thereto or used therewith and of Two hundred and thirty seven negroe or other Slaves which were thereupon on the thirty first day of January last past or of such of them as then remained and of three hundred and seventy three Head of Cattle Horses and Mules the different sorts and kinds of which were set down in the Schedule thereto annexed and of all and every other the live and dead stock provisions and Corn Stores Carts Carriages Wains Waggons and Implements ^[[and Instruments]] of planting and husbandry upon and belonging to the said plantations and penns respectively each of them the said Robert Lord Carrington Samuel Smith and Rene Payne being intitled unto an equal third part of all and singular the said premises -And also reciting that they the said Robert Lord Carrington Samuel Smith and Rene Payne were indebted to the said Samuel Smith, Rene Payne, George Smith and John Smith in the sum of Nineteen thousand one hundred and seventy two pounds eleven shillings, lawful money of Great Britain for advances made by them for and on account of the said plantations penns and premises -And also reciting that the said Samuel Smith and Rene Payne had contracted and agreed with the said Robert Lord Carrington in consideration of the said Sum of Nineteen thousand one hundred and seventy two pounds eleven shillings to be paid to them the said Samuel Smith, Rene Payne, George Smith and John Smith by the said Robert Lord Carrington in manner thereinafter mentioned to grant bargain sell release and confirm unto the said Robert Lord Carrington his Heirs Executors admors and assigns according to the nature of the premises respectively their and each of their one third part undivided and all and every other their and each of their part or parts share or shares right title and interest of in to and out of the said plantation penns Lands Slaves cattle Stock and premises and that the said Samuel Smith, Rene Payne, George Smith and John Smith had agreed to take and accept the Bond of the said Robert Lord Carrington payable in five years from the date thereof for the said sum of Nineteen thousand one hundred and seventy two pounds eleven shillings with Interest in the mean time to be paid annually at the rate of five pounds per centum per annum and to commence two months from the date thereof in full Discharge and satisfaction of the said sum of money so due and owing to them on the amount aforesaid by the said Robert Lord Carrington, Samuel Smith and Rene Payne It was then by the said articles now in recital Witnessed that for and in consideration of the said Sum of Nineteen thousand one hundred and seventy two pounds eleven shillings which was thereinafter covenanted to be secured by the said Robert Lord Carrington in manner thereinafter mentioned they the said Samuel Smith and Rene Payne for themselves respectively and for their respective heirs executors and admors did thereby covenant promise and agree to and with the said Robert Lord Carrington his Heirs Executors admors and assigns that they the said Samuel Smith and Rene Payne their Heirs Executors and Admors should and would within the space of two calendar months next after the date thereof well and sufficiently grant bargain sell release and confirm unto the said Robert Lord Carrington his heirs exors admors and assigns the said two third parts undivided and all and every other the part or parts share or shares right title and interest of each of them the said Samuel Smith and Rene Payne of in to and out of all and singular the said plantations penns Lands Slaves Cattle Stock and premises free from all incumbrances whatsoever And the said Samuel Smith, Rene Payne, George Smith and John Smith did thereby for themselves their heirs exors and admors covenant promise and agree to and with the sᵈ
