Far as the said twenty eight Slaves may be subject to Judgments against Sir Charles Price Baronet deceased And the said Samuel Smith Rene Payne George Smith and John Smith do hereby for themselves their heirs Executors and Administrators covenant promise and agree to and with the said Robert Lord Carrington his Heirs Executors Admors and Assigns by these presents in consideration of the said sum of Nineteen thousand one hundred and seventy two pounds eleven shillings which is hereinafter covenanted to be secured by the said Robert Lord Carrington in manner hereinafter mentioned, that they the said Samuel Smith Rene Payne George Smith and John Smith their Executors or Administrators shall and will upon the due execution of the said Bond hereinafter mentioned by the said Robert Lord Carrington and delivery thereof to them well and sufficiently release exonerate and discharge the said Robert Lord Carrington his Heirs Executors and Administrators of and from the said sum of Nineteen thousand one hundred and seventy two pounds eleven shillings so as aforesaid remaining due and owing by the said Robert Lord Carrington Samuel Smith and Rene Payne to them the said Samuel Smith Rene Payne George Smith and John Smith and of and from every part thereof And the said Robert Lord Carrington doth hereby for himself his Heirs Executors and Admors covenant and agree to and with the said Samuel Smith Rene Payne George Smith and John Smith their Executors and Admors that he the said Robert Lord Carrington his ^[[Heirs]] Executors or Admors on the execution of such Grant Bargain Sale and Release by the said Samuel Smith and Rene Payne their Heirs Executors or Admors as aforesaid and of such Release and Discharge by the said Samuel Smith Rene Payne George Smith and John Smith their Executors or Admors as aforesaid shall and will execute and deliver to them the said Samuel Smith Rene Payne George Smith and John Smith their Executors or Admors a Bond for the payment of the said sum of Nineteen thousand one hundred and seventy two pounds eleven shillings in five years from the date hereof with interest for the same at the rate of five pounds per centum per annum commencing two months from the date hereof and payable yearly And it is hereby mutually covenanted and agreed upon by and between the said Robert Lord Carrington and the said Samuel Smith and Rene Payne that the said Robert Lord Carrington and his Heirs shall have the benefit of all increase of the said two hundred and thirty seven Slaves and take the risque of any decrease from the said thirty first day of January last, but that in respect to the Cattle Horses, Mules whatever is deficient in the number of each kind according to the Schedule hereunder written shall be made good or allowed for in value according to their Interests aforesaid by them the said Samuel Smith and Rene Payne their Heirs Executors or Admors to the said Robert Lord Carrington his Executors Administrators or Assigns And that if there shall be any increase in the said Numbers, two third parts of the value thereof shall be paid by the said Robert Lord Carrington his Executors or Administrators to the said Samuel Smith and Rene Payne their Executors or Administrators and that William Mitchell Esquire his Majestys Receiver General of the said Island of Jamaica ^[[and John Ingram of the parish of Saint James in the said Island Esquire]] shall determine between the said parties what either shall pay to the other in consequence of such deficiency or increase In witness whereof the said parties to these presents have hereunto set their hands and seals the day and year first above written.//- The Schedule above referred to 6 Bulls 59 Breeding Cows 30 Fattening Dͦ 24 Working Steers 5 Fattening Steers 79 Young Steers 56 Heifers 33 Bull Calves 25 Cow Calves 1 Horse 25 Mares 4 Horse Colts 5 Fillies 1 Ass 1 Old Mule 19 Young Mules
