I have carefully examined into this case and decided that the store in question should be vacated at once, full particulars can be given, but Capt Johnston is acquainted with the facts of the case. Respectfully returned. The order for restoration is simply a surrender of control. This Bureau has nothing to do with the claims of other parties either owners or lessees beyond the the time specified in the lease executed by the Genl Agent. It remains with the owner to get possession & with the Lessee or occupant to give possession. We need not order any one to vacate, nor direct as to the right of any other to enter & occupy the property. That question may be settled by the parties themselves. Submits statement relative to certain property belonging to the Betticurt Estate which a freedman claims to have bought while a slave & which he cannot obtain possession of or acquire a title for. Respctfly forward with request that some definite instruction be given in this case to serve as a guide in deciding the numerous cases of a similar nature which come before em. There are many cases in which Slaves have purchased property but being slaves were unable under State Laws to hold a title. The owner holding the Deed while the purchaser occupies the property Sometime during the war the whole Estate was sold and the purchaser now refuses to acknowledge the right of the freedmen to their portion of it. Respectfully returned, This Bureau has no power in such cases.
