The boy was whipped in the evening and bad were his screams that neighboring women came to my office and demanded my interference; and upon walking to the closed warehouse, wherein the whipping was inflicted I could hear the pitiful moans of the boy myself.  Furthermore-at the examination held the next day at my office, the defendant was so defiant in his manner and so impudent in his speech that I felt strongly tempted to demand for him a trial by a Military Commission as his aim was evidently to insult me and my office.  As for the statement that [[underlined]] "I sent the boy to labor on my farm," [[/underlined]] I can only say that it is in keeping with the other assertions made. [[underlined]] I have no farm. [[/underlined]]  The boy being young, and promising to do better, and having received, what I considered a sufficient punishment, illegal as it was, I sent him to the farm worked by destitute freedmen in behalf of the Government where he is still-well behaving and laborious. Forwards his Accounts for transportation.  Endst. of Col. M.C. Garber Chf. Qr. Mr. Dept. of N.C.  Respectfully returned to Lt. Colonel Allan Rutherford V.R.C.  There is nothing on the order indicating a change of Station Par. 1113 Revised Army Regulations which authorizes the payment of actual transportation of a servant.  Payment of that part of the voucher is therefore

Atkinson  Frank (Clr'd) [[Footnote 1]]

Makes statement concerning his arrest &c. [[Footnote 2]] Endst. of Chap. Glavis  Respectfully returned.  Frank Atkinson (freedm) was accused of having severely stabbed with a knife another freedman with whom he had some words at Granger hotel.  Sufficient witnesses were produced to establish not only his guilt, but also to show him to have been the aggressive party.  I sentenced him to 20 days jail and a fine of 25 doll.  Upon the representation of his employer Mr. T.A. Granger who stated that his wife could hardly spare him from the dining room, and that he would vouch for the good behavior of Frank, I remitted the jail but not the fine.  The feeling of the colored people about this time was very intense against the defendant, and it would now produce a very bad effect, if a deed like his was to go wholly unpunished.  Ends't of Capt.
