We beg to advise you that the President signed the Emergency Tariff Bill late yesterday afternoon, making the bill operative this morning at 9 A.M., May 28th, 1921. The salient features of this bill, as they will generally affect import business, are among the following:

The Collector is authorized to accept the Federal Reserve rate on the day of shipment, shown by the Consular Invoice on the depreciated currency in fixing the entry value of imported merchandise, in lieu of the Consular depreciated rate heretofore taken.

The dutiable market value shall be the home market value, or the export value, whichever is higher, instead of heretofore the home value only.

The Secretary and Appraising Officers are given authority on both dutiable and free goods, to determine whether such goods are being dumped on this market in jeopardy to American commerce. The penalty when this determination is made, is a dumping duty equal to the difference between the foreign purchase price, or the exporter's sale price, as against the foreign market value, in addition to the regular amount of duty assessed at the present existing rates.

We recommend, in view of the Longworth resolution now before Congress, making the rates immediately operative in the future permanent tariff bill, which in many cases carry a higher rate of duty, that it might be advisable to importers to pay duty immediately upon arrival, or if they must put goods in Bonded Warehouse, to follow closely the progress of this permanent bill and pay the duty before its passage. It certainly would be to your advantage to consult us before entering your goods.
