7. [[underline]] Ross, v. Powers, and Grunley & Walsh. [[/underline]]

This suit was filed by a Smithsonian contractor's employee seeking damages for work-related injuries.  The suit was dismissed by the Court on December 18, 1973, for failure to state a cause of action.

8. [[underline]] Claims Arising out of Construction of the Hirshhorn Museum. [[/underline]]

As reported previously, a number of claims have been filed by the contractor and various subcontractors employed in the construction of the Hirshhorn Museum.  Two of the smaller claims already have been decided in favor of the General Services Administration, which is responsible for the construction of this building.  Other claims have been heard by the GSA Board of Contract Appeals and not yet decided.  A decision on the principal claim for approximately $1,000,000 is expected soon.  None of these claims represents expansion of the original scope of this museum; they arise from questions such as alleged defective specifications which frequently arise in the course of constructing any large facility.
