the rights and privileges of citizenship with their reciprocal duties than we by taking thought can add a cubit to our stature.  Outside the city of New York an American citizen is not a mushroom growth.  The mere fact that one of the Indians was found plowing corn does not alter the case.  Because an Indian happens to engage in one or more civilized pursuits we must not conclude that he has surrendered his Indian independence and become a part of our sovereignty.  Besides the government has provided a way by which Indians may signify their intention of becoming civilized.

Section 2119 Revised Statutes.

The only clause in the constitution referring to the writ of Habeas Corpus is in Sec 9- article 1 - "The privilege of the writ of Habeas Corpus shall not be suspended unless when in cases of rebellion or invasion the public safety may require it."  What privilege may not be suspended?  Assuredly the the privilege that the people of the United States secured and and guaranteed to themselves.  By the Articles of Confederation "The inhabitants of said territory shall always be entitled to the benefits of the writ of Habeas Corpus and the trial by Jury."
