Said Robert Lord Carrington in manner thereinafter mentioned that they the said Samuel Smith, Rene Payne George Smith and John Smith their Executors or administrators should and would upon the due execution of the Bond thereinafter mentioned by the said Robert Lord Carrington and delivery thereof to them well and sufficiently release exonerate and discharge the said Robert Lord Carrington his Heirs Executors and Administrators of and from the said sum of Nineteen thousand one hundred and seventy two pounds eleven shillings so as aforesaid then due and owing by the said Robert Lord Carrington, Samuel Smith and Rene Payne to them the said Samuel Smith, Rene Payne, George Smith and John Smith and of and from every part thereof And the said Robert Lord Carrington did thereby for himself his Heirs Executors and Administrators covenant and agree to and with the said Samuel Smith, Rene Payne, George Smith and John Smith their Executors and admors,that he the said Robert Lord Carrington his Executors or administrators on the execution of such Grant Bargain Sale and Release by the said Samuel Smith and Rene Payne their Heirs Executors or administrators as aforesaid and of such Release and Discharge by the said Samuel Smith, Rene Payne, George Smith and John Smith their Executors or administrators should and would execute and deliver to them the said Samuel Smith, Rene Payne, George Smith and John Smith their Executors or Administrators a Bond for the payment of the said sum of Nineteen thousand one hundred and seventy two pounds eleven shillings in five years from the date thereof with interest at the rate of five pounds per centum per annum commencing two months from the date thereof payable yearly -And it was thereby covenanted and agreed upon between the said Robert Lord Carrington and the said Samuel Smith and Rene Payne that the said Robert Lord Carrington and his Heirs should have the benefit of all increase of the said two hundred and thirty seven Slaves and take the risque of any decrease from the said thirty first day of January last past but that in respect to the said Cattle Horses and Mules whatever was deficient in number of each kind according to the Schedule thereunder written should be made good or allowed for in value according to their interests aforesaid by the said Samuel Smith and Rene Payne their Heirs Executors or admors to the said Robert Lord Carrington his Executors Administrators or Assigns and that if there should be any increase in the said numbers two third parts of the value thereof should be paid by the said Robert Lord Carrington his Executors or Admors to the said Samuel Smith and Rene Payne their Executors or Administrators and that William Mitchell Esquire his Majesty's Receiver General of the said Island of Jamaica and John Ingram of the parish of Saint James in the said Island Esquire should determine between the said parties what either should pay to the other in consequence of such deficiency or increase as in and by the said articles of Agreement duly executed relation being thereunto had will more fully appear And whereas the sum of Nineteen thousand one hundred and seventeen pounds eleven shillings is the just and true sum due and owing by the said Robert Lord Carrington, Samuel Smith and Rene Payne to the said Samuel Smith, Rene Payne George Smith and John Smith instead of the sum of Nineteen thousand one hundred and seventy two Pounds eleven shillings mentioned in the said recited articles And whereas there was omitted to be mentioned in the said articles a certain Mountain Polink formerly belonging to one Edward Bolt which was some Years since purchased as an addition or appendage to the said other plantations of the Farm Cow park and Half way Tree some or one of them and which is situate in the said parish of St Catherine or in the neighbourhood thereof but it was the true intent and meaning of the said parties to the said Articles of Agreement that as well the said Mountain Polink as all other the Lands Tenements and Hereditaments in the said Island of Jamaica belonging to them the said Robert Lord Carrington, Samuel Smith and Rene Payne or in or to which they the said Robert Lord Carrington, Samuel Smith and Rene Payne or any two of them are interested in or intitled unto in respect of the shares of them the said Samuel Smith and Rene Payne should be conveyed and assured unto the said Robert Lord Carrington together with the said plantations or penns called the Farm, Cow Park and Halfway Tree for the consideration expressed in the said Articles of Agreement And whereas the said Robert Lord Carrington hath this day paid to them the said Samuel Smith, Rene Payne George Smith and John Smith the sum of One hundred and seventeen pounds eleven shillings of lawful money of Great Britain and the said Robert Lord Carrington hath also entered into and executed unto and in favor of them the said Samuel Smith, Rene Payne, George Smith, and John Smith a certain Bond or Obligation bearing even date herewith in the penal Sum of Thirty eight thousand pounds of lawful money of Great Britain with a condition thereunder written to be void on payment of the sum of Nineteen thousand pounds of like lawful money residue of the said Sum of Nineteen thousand one hundred and seventeen pounds eleven shillings in manner following (that is to say) the sum of Nine hundred and fifty pounds of like lawful money being one years Interest of the said principal sum of Nineteen thousand pounds at or on the Twentieth day of September in the year
