5.06 [[underlined]] General Counsel. [[/underlined]] In consultation with the Board of Regents, the Secretary shall appoint a counselor who shall serve as general counsel to the Institution and shall advise the Secretary on such legal matters as may be referred to the counselor by the Secretary or the Board of Regents or its committees. Section 6 - Financial Administration

6.01 [[underlined]] Authority to Receive Contributions. [[/underlined]] In accordance with policies established by the Board of Regents, the Secretary may receive gifts, bequests, devises, legacies, donations and other transfers for purposes consistent with the Institution's Charter and, upon such acceptance, shall administer and budget the use of such contributions for the purposes specified, if any. 6.02 [[underlined]] Endowment Fund; Other Nonappropriated Funds. [[/underlined]] Unless otherwise designated by the donor or directed by the Board of Regents, all monies derived from gifts made by will, trust, or similar instrument shall be received in and held in the Smithsonian Institution endowment fund. The Board of Regents may augment the Institution's endowment fund from time to time through budgetary transfers of the net income derived from investments, donations, or revenues from auxiliary activities.
