Sir,
I have the honor to acknowledge the receipt of your communication of the 20^th Inst and in reply to say that the order to which you refer was one in which I assumed the duties of Sub. Asst Commissioner for the counties embraced in this Mil Post. as required by G. O. No 145 [[?]] C. S. Dist Hd Qrs. and which directed Capt Rutherford to turn over to me "all records orders and instructions appertaining to this office" In reply Capt Rutherford informed me that he had been ordered by Genl Miles verbally to decline obeying this order, The matter was referred to Genl Comby and the following is an extract from his reply

The records now in the possession of the Agents of the Bureau in relation to questions of administration remain in their hands until they are releived or discharged by orders from the Commissioner but they will furnish from their records any information that relates to the duties of protection of persons and property with which
