Respectfully forwarded to Lieut Col [[underlined]] Jacob F. Chur [[/underlined]] with the information that the within affidavit of Washington Bobbett (F) together with the points of law relied on was submitted to me by B.A. Lavender his counsel before the motion was made.— I did not entertain the slightest doubt but that the Court would cancel the Indenture immediately.

This has not been done & the rules of the Supreme Court of N. Ca. have been entirely ignored by the Co. Court (an inferior tribunal) It is respectfully
