I have the honor to return the enclosed papers with the following report. I called upon Colonel William Hoke as requested in your communication and made inquiries in regard to the case of Capt Henry; Colonel Hoke denies that any officer or Soldier was shot by his order while he was in command at Charlotte N.C. He also states that he never ordered a Court-Martial to try a case while in Charlotte. The only instance he says that he knew of an officer of the Federal Army being shot in that vicinity was one that was shot by the General of a Georgia regiment who was conveying prisoners to Salisbury he states that the guard referred to was not under his command and the officer was shot while in the act of escaping (over)
