oversight, intelligent exhibition and careful protection of the collections transferred by the will of the late Charles L. Freer; and to incorporate in the contract for the services of said curator an agreement that any additional services under the terms of said will shall be paid by said curator in such sums as may be agreed upon.

On motion, the resolution was adopted.

[[underlined]] Item 2. [[/underlined]]

"Nineteenth.  I give and bequeath to said Smithsonian Institution the sum of two hundred thousand dollars ($200,000) in the capital stock of said Parke, Davis & Company, at the market value thereof at the time of my death, the cash dividends on said stock, or income derived from the proceeds thereof, to be used by the Regents of said Institution for the creation of ornamental gardens within the court and corridors of said building and on the grounds immediately surrounding it, and for the purchase of suitable American statuary, including permanent wall panels, for erection at appropriate places in said court and corridors; and I request the Regents of said Institution to consult fully with Mr. Charles A. Platt, the architect of the building now under erection, concerning the choice of materials to be used and the sculptors to be employed.  The architectural features involved in this bequest I ask the said Regents to entrust to the aforesaid Charles A. Platt. 

This item requires the approval of the Regents in consulting with Mr. Charles A. Platt, the architect of the building, for the creation of ornamental gardens, purchase of American Statuary, wall panels, etc., and the entrusting to him of the architectural features involved.  In order to carry this into effect, the following resolutions are offered:-

RESOLVED; That the Secretary, with the approval of the Permanent Committee, is authorized to consult with Charles A. Platt, architect of the Freer Gallery of Art, concerning the choice of materials to be used and the sculptors to be employed in making American statuary when the same is approved by the advisory committee of the National Gallery of Art.

RESOLVED; That questions pertaining to the ornamental gardens within the court and the grounds surrounding the building be similarly referred to the Secretary with power to act.

On motion, the resolutions were adopted.

"Twentieth. I give and bequeath to said Smithsonian Institution capital stock of said Parke, Davis & Company, of the market value at the time of my death of fifty thousand dollars ($50,000). The cash dividends on said stock, or the income derived from the proceeds of the sale thereof, shall be used solely for the care and maintenance of the gardens and statuary provided for in the next preceding paragraph of this will."

As this is a question involving the care and administration of the gardens and statuary provided for in Item 2, the following resolution is submitted:
