Court of Appeals affirmed the Federal District Court's decision, holding that the dismissal of the claims was correct since the finders, the Museum of the County of Sam Bernardino, and the State of California failed to state a claim upon which relief could be granted. No appeal has been taken from that decision.

In this suit, filed in the U. S. District Court for the District of Columbia in October 1979, plaintiff sought damages of $500,000 for personal injuries sustained in a fall at the National Zoological Park in May 1977. The suit was based on a denial of a federal tort claim. In August 1980 plaintiff requested that the suit be dismissed.
