4th Article of the treaty of March 6, 1865, and considering also the fact that his family have returned to the reservation with the evident purpose of making it their permanent abode, I think his application for an allotment should be granted, and I therefore concur in your decision in the case.

It is proper to add that the allotment made to Cabana was cancelled for the reason that the tract assigned to him fell within that portion of the resrvation which the Omahas sold and deeded to the Winnebagoes in 1874.
