The act says: (Sec. 2)

"Each bona fide settler, occupying any portion of said lands, and having made valuable improvements thereon, or the heirs at law of such settler, [[underlined]] who is a citizen of the United States [[/underlined]] or who has declared his intention to become such, shall be entitled to purchase" &c. &c.

The Omahas have never acquired citizenship, and there is no general law by which they can become citizens. Indians cannot become citizens by naturalization under existing general acts of Congress. Those acts apply only to [[underlined]] foreigners, [[/underlined]]
