In view of all the facts which have come to my knowledge it seems proven that the claims of Euphrasia Peters as set forth in her affidavit are not solid.  To be enrolled upon the pay roll of the tribe in 1854, does not constitute a  title to an allotment of land under Art. 4. of the treaty of March 6, 1865, if the person was a non-resident of the tribe.  During the period of [[?1861]] to [[?1878]], Mrs. Peters swears she was not living on the Omaha reservation and therefore she is not provided for in Art. 4. of the treaty of 1865.  That she selected lands for herself and her children with the consent of the tribe has been denied in two open councils, one held May 23
