Sir:

I herewith enclose the application of Frank C. Waggoner received today.

Frank C. Waggoner is the son of Jane Waggoner who drew out from the tribe in 1871. Frank was born March 21.1863. His share in the cash property of the tribe was paid to his Mother. but he has never received any land. He claims his right under the treaty of 1859 to an allotment and also that he have his right to law on the Minnesota reservation transferred to this land.

That he has a right to land in Minnesota seems clear from the reading of the law of 1870. since he has never had his share of the Realty of the tribe. but it is a question whether this right can be adjusted outside of Minnesota with out Congressional action. I have therefore the honor to submit his claim to the Department requesting that the reply be addressed to Mr Waggoner at this Agency.
