from that year to the present.  In accordance with his bequest, said agent John B. Monteith allotted the land now claimed by Moses, to Brouchs, which tract, had not, [[underline]] at any time prior thereto, [[/underline]] been cultivated by the government employes as agency or School lands and had not been claimed as such, by any preceeding Agent.

One or two years later James Moses moved on the reserve, and on account of friendship, occupied with Thomas Brouche, the land in question, in a common way, and both cultivated said tract of land, without interruption on part of any government official or any other person, for many years.
