2 Specification 3d--In this, that he, 2nd Lieutenant James H. Simpson, 120th Ind. Vol. Inf, did get intoxicated with one Sergeant John H. Scott, an enlisted man of Co., G 120th Indiana Infantry. All this at Raleigh, N. C., on or about November 15th, 1865. Specification 4th--In this,m that 2nd Lieutenant James H. Simpson, 120th Ind. Vol. Inf., did neglect his duty while in command of his Company on detached service, by allowing the arms and accoutrements of his Company to become rusty and dirty. All this at Raleigh, N. C., on or about the 10th day of October, 1865. CHARGE III. Disobeying the lawful commands of his superior Officer Specification--In this, that 2nd Lieutenant James H. Simpson, 120th Ind. Vol. Inf., did, while his Company was on detached service, allow his men to wear citizen clothing, and "Rebel Gray." This in violation of the order of the commanding officer of his Regiment. All this at Raleigh, N. C., on or about the 10th day of October, 1865. CHARGE IV. Drunkenness on Duty. Specification 1st--In this, that he, said 2nd Lieutenant James H. Simpson, 120th Ind. Vol. Inf., was found drunk while on duty as officer of the guard. This at Raleigh, N. C., on or about November 7th, 1865. Specification 2d--In this, that he, said 2nd Lieutenant James H. Simpson, 120th Ind. Vol. Inf., was found drunk while on duty as officer of the guard. All this at Raleigh, N. C., on or about November 14, 1865. To which charges and specifications the accused pleaded as follows: CHARGE I. To the specification to the charge, "Guilty." To the charge,, "Guilty." CHARGE II. To the specification of that charge, "Guilty," except the words, "and in the presence of enlisted men," and "swearing."
