HEADQUARTERS DEPARTMENT OF NORTH CAROLINA, Raleigh, North Carolina, December 26th, 1865. GENERAL ORDERS,} No. 178, } I. * * Before a Military Commission, convened at Salisbury, North Carolina, November 6th, 1865, pursuant to Special Orders, No. 50, dated Headquarters District of West North Carolina, October 28th, 1865, and of which Lt. Col. E. W. PENNY, 130 Ind. Inf. is President, was arraigned and tried: Shack, Freedman of Lincoln County, N.C. CHARGE. Rape. Specification--"In this, that the said Shack, a Freedman of Lincoln County, N.C., did, on or about the 8th day of July, 1865, violently, feloniously, and with force, commit rape upon a colored girl, named "Amelia," under ten years of age. This on the 7th day of July, 1865, near Lincolnton, North Carolina." To which Charge and Specification the prisoner pleaded as follows: Of the Specification to the Charge, "Not Guilty." Of the Charge, "Not Guilty." FINDING. The Commission having maturely considered the evidence adduced, finds the prisoner, Shack, Freedman of Lincoln County, North Carolina, as follows: Of the Specification to the Charge, "Guilty." Of the Charge, "Guilty." SENTENCE. And the Commission do therefore sentence him, the said Shack, Freedman of Lincoln County, North Carolina, to be hanged by the neck until dead, at such time and place as the Commanding General may direct, two-thirds of the members of the Commission concurring therein. II. The proceedings, findings and sentence in the foregoing case are approved and confirmed. The sentence is hereby mitigated to one
