On motion of the defts in this cause, the report required by the rule in this cause not being completed they are allowed until tomorrow to file the same, and the case is continued bill then for that purpose.

The State of West Virginia at the relation of Theordore Moulton vs }
The Board of Education of Harpers Ferry township, }
and the Trustees of Dist No 1, of said township. }

The said Board of education this day returned and filed their report, required by the order made at a former term in the cause, together with the affidavit of E. W. Andrews, together with the enumeration duly certified showing the number of colored children between the ages of six and twenty-one, in said dis't No 1, for the year 1866, alleging in said report an error as to the number as reported by the commissioner confirmed at a former term, and upon consideration of the matter submitted, and the circumstances shown accounting for their failure to show the [[strikethrough]] Court correct the [[/strikethrough]] correct enumeration before the commissioner, the Court is of opinion that said Board should be allowed, at their own cost, to show by evidence
