Ben Simpson, freedman, called, and being duly sworn, stated.

That last spring the mules got out of the stables into the rice patch, and that Dan and himself were in the house eating breakfast, Mr. R. halloed to Dan to go and get the mules up, and told him if the mules got out again he would whip him for it. After Dan put the mules up Mr. R. came out with a stick — took Dan by the collar, carried him in the yard, tied him and whipped him with a split hoop pole. As nigh as I can guess, he whipped him an hour over his shirt, and while he was whipping him, told him if he would live with him until he was twenty one he would give him two suits of clothes and $100. He kept him tied until after 12 o'clock. He tied him at first when the sun was only one hour high. Dan was laid up Monday and Tuesday — Wednesday he went to hauling timber.
