It is proper further to report that the first sentence was given imposing Fines and Costs as above and One hundred & forty four dollars (1 years wages) for Dan'l. Bagley (Freedman) and Thirty days imprisonment for each offense whereof Defendant was convicted.

An Appeal was then mentioned by Defendant & he was told to whom & how he could appeal. He seemed unwilling and yet desirous to appeal. I told him it would be granted at once if requested. An appeal was then made to me to mitigate the sentence by commuting the imprisonment by means of Fines &c..  This was urged and was understood by me as a fair offer to compromise and after consulting my attorney I gave the first sentence appearing above.  This can be done legally & sentenced changed as long as the Court remains in session upon the case. It is called by Courts business "in fieri".  After I passed this sentence making Damages $500. Defendant went out to obtain money but comes back and appeals the case. I took Bonds in $2,000. as forwarded and now submit both sentences to you as equally requiring consideration.
