that he saw Stephen Sutherland on the 19" day of January 1866 coming from henderson about 10 
O Clock at Mr Stephen head a horse and wagon there was a box on the waggon Stephen was standing in the box there ^[[insertion]] was [[/insertion]] no load on the wagon the box was empty

Thomas Overly duly sworn upon his oath sayes that he resides in Granvill County N Car that he is not acquainted with Defendant that on the 19" Jan 1866 Defendant came to his house with two baggs of Cotton and offerd them to me for sale I bought them and paid him ten dollars in silver on the next Monday he came to me and asked me to deny buying the cotton from him I told him no I had bought it honestly and if he had stolen the cotton he should not of sold it to me I had sold the cotton to Parker.
