8. [[underlined]] Shepard v. Adams [[/underlined]]

This suit was filed in the U.S. District Court for the District of Columbia on July 22, 1986. Plaintiff alleges discrimination on the basis of color and race under Title VII of the Civil Rights Act of 1964, as amended. Plaintiff, a secretary in the Office of Printing and Photographic Services, alleges she was denied promotion, training, and other benefits as a result of discriminatory practices and seeks retroactive promotion and back pay and benefits, among other relief. Trial was held on June 4, 5, 8, and 9, 1987, and the case was dismissed at the close of plaintiff's case. A notice of appeal of the dismissal was filed on November 9, 1987.

There have been no significant developments in the following cases, which have been reported previously to the Board:

9. [[underlined]] Buffotot v. Smithsonian, et al. [[/underlined]] (alleged copyright infringement by the Smithsonian Press in the publication of the English translation of the original French work [[underline]] A History of French Military Aviation [[/underline]]) - Brought by the French authors before the Tribunal of the Grand Instance in Paris on February 12, 1987. Plaintiffs seek approximately F. 427,000 in damages. The case is being handled by the U.S. Department of Justice, which has hired an attorney in Paris to represent the Institution.

10. [[underlined]] In re the Estate of William H. Burnette [[/underlined]] (petition for instructions as to the proper distribution of certain art work and WWI memorabilia bequeathed to the SI Anacostia Neighborhood Museum) - Filed January 1986 in the Probate Division of the Superior Court of the District of Columbia. Settlement negotiations are in progress.

11. [[underlined]] Faust v. Adams [[/underlined]] (appeal of removal for unsatisfactory performance by former microbiologist of the Smithsonian Environmental Research Center (Edgewater)) - Filed May 15, 1986, in the U.S. District Court for the District of Columbia, alleging removal was not meritorious, was procedurally defective, and was discriminatorily based on her age, sex, and national origin (Hungarian). Retro-active reinstatement to a suitable GS-13 position, a granting of a fully satisfactory performance evaluation for 1984 and of a retroactive within-grade increase, back pay and benefits, and attorneys' fees and costs are sought. Pretrial statements were filed March 30, 1987. A pretrial conference was held April 13, 1987, and trial was set for May 5-8, 1987. Trial was indefinitely continued, and settlement discussions are ongoing.

12. [[underlined]] Howze v. Adams [[/underlined]] ([[underlined]] pro se [[/underlined]], racial discrimination) - Filed November 3, 1986, in the U.S. District Court for the District of Columbia by a Smithsonian sheetmetal mechanic, alleging discrimination on the basis of race in failure to be promoted to the position of foreman in 1982. Promotion to the position of foreman, back pay, and punitive damages are sought. Trial has been rescheduled for March 28, 1988.
