This indenture made this the 3rd day of July 1863 between E Nye Hutchison and John Wilkes of the County of Mecklenburg and State of North Carolina of the one part and the Confederate States of America of the other part, Witnesseth that the said party of the first part for and in consideration of the Sum of Fourteen Hundred Dollars to the said party of the first part in hand paid the receipt whereof is hereby acknowledged, hath sold and conveyed, and doth hereby sell and convey to the said party of the second part all that tract or parcel of land lying in the County of Mecklenburg and State of North Carolina bounded as follows to wit, situated Lying and being in the Town of Charlotte Consisting of two Lots known and designated in the plan of said Town as Lots No 237 & 238, in square No 36, being properly formerly owned by Wm Allison deceased and sold under a decree of the Court of Equity for purposes of partition subject nevertheless to the restoration of the possessing rights of the North Carolina RRd Co on that portion of Lot 238 now occupied by said Corporation, to have and to hold the same with the appurtenances thereunto belonging to the said party of the second part his assigns forever, and the said party of the first part for the consideration aforesaid doth hereby covenant and agree to warrant and defend the premises aforesaid to the party of the second art and his assigns against the Claim and Entry of all persons whatsoever and they do further covenant that they are seized of the premises in fee simple, and have power to make and convey such an Estate by this Indenture, and hath done the same by these presents to the Confederate States of America,
