Dear David:

Enclosed are copies of documents pertaining to the proposed National Museum of the American Indian. Chief among them is the agreement that has been signed by Julie Kidd, the chair of the Heye Foundation Trustees. An article-by-article analysis of the agreement is included. 

The schedules referenced in the first article of the agreement are not yet available, although I am told that they have been assembled and are currently being reviewed by the Heye Foundation attorneys in New York. While clearly important in themselves, I do not believe it is necessary to distribute them at this time. 

I would note, too, that the status of and the process for transfer of the Heye Foundation's library is not entirely clear. Last month I met with a representative of the Huntington Library to which the major portion of the Heye Foundation library was transferred a number of years ago. He wants the Heye material to come to the Smithsonian, but we have not been able to discuss details with him since that time. Harry Baldwin is now seeking to do so.

You will find enclosed a copy of the draft of a letter from by Richard Darman, director of the Office and Management and Budget, to Senator Inouye about Administration support for the museum. A copy of the final version is expected early next week, but the interests of time and the information it contains seemed to warrant forwarding the draft to you now. We have discussed internally its requirement for non-Federal funding, but need to have refined estimates in hand before continuing that discussion with the Board of Regents. With respect to the estimates, I am enclosing a copy of a recent overview of them prepared by our Office of Planning and Budget, together with a paper on the Heye
